About BloomHausBloomHaus is a creative commerce platform designed to help visual artists grow sustainable businesses through sales enablement, marketing support, workshops, commercial partnerships, and curated opportunities.BloomHaus does not claim ownership of artists’ original artwork and acts as a facilitator between artists, collectors, businesses, and partners.2. EligibilityBy using BloomHaus, you represent that:You are at least 18 years old, or have permission from a legal guardian.You have the authority to enter into these Terms.Any information you provide is accurate and complete.3. Artist Accounts & Submissions

Artists may submit artwork, images, descriptions, and related materials (“Artist Content”) to BloomHaus for display, promotion, and participation in opportunities.Artists are solely responsible for the content they submit.4. Ownership & CopyrightArtists retain full ownership and copyright of all original artwork submitted or displayed through BloomHaus.Nothing in these Terms transfers ownership of intellectual property to BloomHaus or to any third party unless expressly agreed to in writing.5. License Granted to BloomHausBy submitting Artist Content, artists grant BloomHaus a non-exclusive, royalty-free, revocable, worldwide license to use, reproduce, display, distribute, and publish images of the artwork solely for the following purposes:Marketing and promotion of the artist and BloomHausFacilitating sales, commissions, workshops, or partnershipsWebsite, social media, newsletters, and promotional materialsOperational and administrative purposes related to BloomHaus servicesThis license does not allow BloomHaus to sell, sublicense, or commercially exploit artwork outside of agreed-upon opportunities.6. Third-Party Use & Website VisitorsAll artwork displayed on the BloomHaus website is protected by copyright law.

Website visitors may not:Download, reproduce, distribute, or modify artworkUse artwork for commercial or promotional purposesCreate derivative works without written permission from the artistUnauthorized use may result in legal action.7. Artist Representations & WarrantiesBy submitting artwork, artists represent and warrant that:The artwork is original or they hold all necessary rights and licensesThe artwork does not infringe upon copyrights, trademarks, or other intellectual property rightsAny references, photographs, fonts, or materials used are properly licensed or originalThe artwork does not violate any laws or third-party rights8. IndemnificationArtists agree to indemnify, defend, and hold harmless BloomHaus, its officers, directors, partners, and affiliates from any claims, damages, losses, liabilities, or expenses (including reasonable legal fees) arising out of:A breach of these TermsClaims of copyright or intellectual property infringementMisrepresentation regarding ownership or rights to submitted artwork

Compensated & Commissioned WorkBloomHaus may facilitate compensated opportunities, including commissions, installations, window paintings, workshops, or commercial placements.Unless expressly stated otherwise in a separate written agreement:Artists retain full copyright ownershipClients receive a limited license for agreed-upon display or useArtwork is not considered “work-for-hire”Any variation from this standard must be documented in writing and agreed to by all parties.10. Payments & FeesPayment terms, commissions, revenue shares, and compensation details vary by opportunity and will be disclosed separately.BloomHaus is not responsible for disputes between artists and third-party clients unless explicitly stated in an agreement.11. Attribution & PromotionBloomHaus will make reasonable efforts to credit artists when displaying or promoting their work.Artists grant BloomHaus permission to use their name, likeness, biography, and artwork images for promotional purposes related to BloomHaus services.12. DMCA & Copyright Complaints

TerminationBloomHaus may suspend or terminate access to the Services at any time for violation of these Terms.Artists may request removal of their content, subject to fulfillment of any existing agreements or obligations.

15. Disclaimer of WarrantiesThe Services are provided “as is” and “as available.” BloomHaus makes no warranties regarding:Sales outcomesArtist exposure or revenueThird-party client behavior16. Limitation of LiabilityTo the maximum extent permitted by law, BloomHaus shall not be liable for indirect, incidental, or consequential damages arising from use of the Services.17. Governing LawThese Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to conflict of law principles.18. Changes to These TermsBloomHaus may update these Terms from time to time. Continued use of the Services constitutes acceptance of the revised Terms.19.
